When you start creating your Privacy Policy, the first set of questions will be used to determine what privacy laws apply to you, and thus what disclosures your Privacy Policy needs to contain. The question of "do you do business in Nevada" will determine whether you need to comply with Nevada's privacy law, Nevada Revised Statutes Chapter 603A.
Doing business in Nevada means engaging in one or more of the following activities:
- Purposefully directing one's activities towards Nevada;
- Consummating a transaction with the State of Nevada or resident of Nevada;
- Purposefully availing oneself of the privilege of conducting activities in Nevada; or
- Otherwise engaging in any activity that constitutes sufficient nexus with Nevada to satisfy the requirements of the U.S. Constitution.
A good rule of thumb is that if you have customers in Nevada, you should select "yes". If you do select "yes" to this question, you will be asked additional questions to meet the disclosure requirements under this law.
