When you are answering the Terms of Service questionnaire, you will be asked whether you do business with individual consumers, large businesses, or small businesses. You are being asked this question to determine whether Australia's consumer protection laws apply to you (consumer protection laws dictate how the disclosures within your Terms of Service are drafted. 

  • Individual consumers are individuals acting for purposes that are wholly or mainly outside that individual's trade, business, craft, or profession. An example of a consumer would be an accountant purchasing hair dye. In addition, a consumer is a person that purchases goods, services, or digital products that cost less than AUD $100,000. Australia's consumer protection laws apply to individual consumers. 
  • A business is an organization or enterprising entity that is engaged in commercial, industrial or professional activities. A business that purchases goods, services, or digital products that cost less than AUD $100,000 is considered a small business, which entitles the business to certain protections under Australia's consumer protection laws. A business that purchases goods, services, or digital products that cost more than AUD $100,000 is considered a large business and Australia's consumer protection laws do not apply to such businesses.
