When you are answering the Privacy Policy questionnaire, you will be asked whether you want to provide Virginia Consumer Data Protection Act (VCDPA) rights to residents of Virginia only or to everyone that visits your website or application, regardless of location. VCDPA provides the following privacy rights to residents of Utah:
- The right to opt out of sales of personal information;
- The right to opt out of the use of personal information for the purposes of targeted advertising;
- The right to opt out of the use of personal information for the purposes of profiling in furtherance of decisions that could produce legal or similarly significant effects concerning the individual;
- The right to not be discriminated against based upon the exercise of privacy rights;
- The right to request the deletion of some or all of the personal information that the business has collected about the individual;
- The right to access the personal information that is held about the individual;
- The right to receive the personal information that is held by the business about the individual in a portable and, to the extent feasible, readily usable format that allows the individual to transmit that information to another entity;
- The right to request the amendment of any of the information that was collected about the individual.
By law, these rights are provided to residents of Virginia only. However, some businesses may want to provide these rights to every website or application visitor as doing so can:
- Prevent the work inherent in confirming the individual's place of residence when they request to exercise their privacy rights;
- Reduce the confusion of individuals as to what privacy rights apply to them;
- Help reduce the length of your Privacy Policy, especially if you have to comply with multiple privacy laws.
