To answer this question, please select “yes” if an individual can purchase goods, digital content, digital services or services directly on your website or application or through a payment portal on your website or application. This means that individuals can make purchases through an eCommerce portal on your website or application or through a payment portal (e.g. they are linked directly to PayPal to make their purchase). 


You should select “no” to this question if any of the following apply: 

  • Individuals cannot purchase anything on your website or application; 

  • You simply display goods, digital content, digital services or services but the consumer is taken onto a website or application managed by a third party (e.g. Amazon) to make the actual purchase. Please note that this is different from a simple payment portal managed by a third party payment processor such as PayPal; 

  • You display goods, digital content, digital services or services but the user is taken to a website or application managed by a third party where that third party’s Terms of Service will govern the terms of the purchase or the agreement (e.g. the third party dictates whether the individual can get a refund); 

  • You have a separate contract that you have your customers sign when making a purchase that discusses the terms that apply to the purchase (e.g. you send a contract to your clients that discusses whether the client can get a refund).
