Please note that the mere fact that your website or application is accessible in the EU or the EEA does not automatically mean that you are offering goods or services there. On the other hand, the presence of one or more of the following factors does mean that you are offering goods or services to EU and/or EEA residents:

  • The EU and/or the EEA or at least one member country is designated by name with reference to the good or service offered (e.g. “the best frozen pizza in France);

  • You pay a search engine operator for an Internet referencing service in order to facilitate access to your website or application by consumers in the EU and/or the EEA, or you have launched marketing and advertising campaigns directed at an EU and/or EEA country audience (e.g. when running advertisements, you selected that you would like those advertisements to appear in France);

  • The informational nature of the activity, such as tourism (e.g. you offer a special tour package for tourists from France);

  • The mention of a dedicated address or phone number where you can be reached from an EU and/or EEA country (e.g. your website lists an address in France where individuals can inquire about your products or services);

  • The use of a top-level domain that refers to an EU and/or EEA country (e.g. your domain ends in .eu or .de);

  • The description of travel instructions from one or more EU and/or EEA countries to the place where the goods or services are provided (e.g. your website provides directions on how to get to your office from a place in France);

  • The mention of an international clientele composed of customers who live in various EU and/or EEA countries, in particular by the presentation of accounts or reviews written by such consumers (e.g. your website lists a review from an individual located in France);

  • The use of a language or currency that is generally used in the EU and/or the EEA (e.g. you list your prices in Euros or provide the website in French); or

  • You offer the delivery of goods in EU and/or EEA countries (e.g. you ship to France).
