When you are answering the Privacy Policy questionnaire, you will be asked whether you want to offer Indiana SB5 rights to residents of Indiana only or to everyone that visits your website or application, regardless of location. Indiana SB5 provides the following privacy rights to residents of Indiana:
The right to opt out of the use of personal information for targeted advertising;
The right to opt out of the use of personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects;
The right to say no to the sale of personal information;
The request to request the deletion of all or some of the information that a business has collected about a consumer;
The right to access the personal information that was collected about a consumer;
The right to request information in a portable and, to the extent feasible, readily usable format that allows the consumer to transfer that information to another entity;
The right to not be discriminated against based upon the exercise of privacy rights;
The right to confirm whether a business is processing the consumer’s personal information;
The right to request that a business amends any of the information collected about a consumer.
Indiana SB5 provides these rights to residents of Indiana only. However, some businesses may want to provide these rights to every website or application visitor as doing so can:
Prevent the work inherent in confirming the individual’s place of residence when they request to exercise their privacy rights;
Reduce the confusion of individuals as to what privacy rights apply to them;
Help reduce the length of your Privacy Policy, especially if you have to comply with multiple privacy laws.
To answer this question, please select whether you would like to offer the above privacy rights to residents of Indiana only or to everyone that visits your website or application, regardless of their location.
