When you are answering the Privacy Policy questionnaire, you will be asked whether you want to provide Montana Consumer Data Privacy Act (MCDPA) rights to residents of Montana only or to everyone that visits your website or application, regardless of location. MCDPA provides the following privacy rights to residents of Montana: 

  • The right to opt out of the use of personal information for purposes of targeted advertising; 

  • The right to opt out of the use of personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning the individual; 

  • The right to say no to the sale of personal information; 

  • The right to request the deletion of all or some of the information that has been collected about the individual;

  • The right to access the personal information that has been collected about the individual; 

  • The right to request personal information in a portable, and, to the extent feasible, readily usable format that allows the individual to transmit that information to another entity; 

  • The right to not be discriminated against based upon the exercise of privacy rights; 

  • The right to confirm whether a business is processing the individual’s personal information; 

  • The right to request that we amend any of the information that the business has collected about the individual. 

By law, these rights are provided to residents of Montana only. However, some businesses may want to provide these rights to every website or application visitor as doing so can: 

  • Prevent the work inherent in confirming the individual’s place of residence when they request to exercise their privacy rights; 

  • Reduce the confusion of individuals as to what privacy rights apply to them; 

  • Reduce the length of your Privacy Policy, especially if you have to comply with multiple privacy laws.
