To answer this question, please select “yes” if you annually buy, receive, sell or share the personal information of 75,000 or more Louisiana consumers, households, or devices.

“Personal information” is generally defined as any information that could be used to identify a particular person or any information that relates to an identified person. Examples of personal information include:

  • Name;

  • Email;

  • Physical address;

  • Phone number; or

  • IP address.

Websites and applications will usually collect personal information through features such as:

  • Contact forms;

  • Email newsletter sign up forms;

  • Analytics features (e.g. Google Analytics);

  • eCommerce;

  • Advertising (e.g. Meta Pixel).

Buying personal information means purchasing it from a third party such as a data broker. For example, purchasing an email list for $50 would be considered buying personal information. In this case, “sale” is defined as “the exchange of personal information for monetary or other valuable consideration.” Due to this broad definition, selling can include practices such as:

  1. Providing your email marketing list to a data broker for $500; or

  2. Exchanging your website visitors’ personal information (e.g. IP address) for better analytics.

Sharing personal information means sending that information to a third party. For example, if you use a third party email marketing provider such as MailChimp or ConstantContact to send email marketing newsletters, this would be considered sharing personal information as the third party is gaining access to your email list.
